How to Bail Someone Out of Jail in Austin

February 21, 2022

My friend was just arrested in Austin, Texas. How do I get them out of jail?

An arrest can be one of the most frightening experiences a person can go through. There is the negative stigma of a criminal record, the anxiety of not knowing how long someone may be detained, and the fear that the person being arrested may be mistreated in jail.

One thing is certain, jail is a terrible place to be. So, how do you bail someone out of jail as fast as possible?

If you or a loved one is arrested, the first thing you should do is call a lawyer. That’s right! Many people think they need to call a bondsman first. However, in almost every case, the best thing you can do is call a lawyer first. A lawyer can provide legal advice and help with IMMEDIATE jail release.

What happens when someone gets arrested in Austin, Texas?

Booking

After an arrest, individuals are immediately taken to central booking.  In Austin, central booking is also known as the Travis County Jail. The Travis County Jail is run by the Travis County Sherriff’s Office and is located at 500 W. 10th St., Austin, TX 78701.

Once the arrestee is in central booking, they are identified and searched.  Searches consist of a detailed “pat-down” of the person (including all clothing) and a search of any personal belongings (including backpacks, purses, and wallets).  If any contraband is found, the arrestee may face further charges.  Sherriff officers then confirm the identity of the arrestee and check if they have any outstanding warrants.  An arrestee is then fingerprinted and has their mugshot taken for record-keeping purposes.

Unfortunately, an arrestee’s mugshot then becomes part of the public record! This means anyone that requests a copy (including media personnel) will be given a copy of the arrestee’s mugshot to use as they please!

The booking process usually takes anywhere from 3-6 hours, depending on how busy the jail is.

A Bond is Set

Once the individual is booked, they must wait to see a magistrate judge. Within 48 hours of a person’s arrest, the person must be taken before a judge, advised of the charges, advised of their rights, and have a bond set on their case. In Austin, a person is usually brought before a judge within 12 hours of their arrest to have a bond set on their case.

What is a Bond? A bond is the amount of money that an individual must pay in order to get out of jail while their criminal case is pending.  Bonds are set in criminal cases to secure the arrestee’s presence at any future court proceedings. The amount of bond depends on the severity of the charge, the persons’ criminal history, and the risk that the person may flee after release.

How do I bail person out of jail as quick as possible?

Whether you or a loved one have been arrested for driving while intoxicated, drug possession, assault, theft, family violence assault, or any other felony, the very first thing you should do is call a lawyer!

In Travis County, Austin, Texas, a lawyer can get someone out of jail by securing what is known as a “personal recognizance bond” or “PR bond.” With a PR bond, an individual will be released from jail “on their own recognizance,” which means they will be released without having to pay any amount towards the bond.  They will be released after signing a piece of paper, promising to appear at all court proceedings. ONLY a lawyer can secure a PR bond.

Additionally, unlike a bondsman, a lawyer can provide you and your family with legal advice to help protect you from the charges. Your legal defense to any criminal charge starts from the minute you come into contact with a police officer. An experienced lawyer can answer all your legal questions and start building your defense as soon as you get them on the phone. Lastly, a lawyer can IMMEDIATELY visit you or your family member in jail to advise them of their rights and to make sure they are not being mistreated.
